Introduction

The Federal Communications Commission (“FCC”) has adopted rules requiring broadband Internet access service providers—including providers like Spectrotel that operate as resellers of third-party broadband Internet access services—to publish certain information about their services. In accordance with those rules, this document provides information concerning the mass-market broadband Internet access service offerings resold by Spectrotel to residential customers and small businesses. These disclosures are intended to provide information to customers who currently obtain mass-market broadband Internet access service through Spectrotel or who may do so in the future, as well to providers of applications, services, and content accessed by Spectrotel’s end users.

Network Management

As a reseller of broadband Internet access service, Spectrotel does not operate its own broadband networks and therefore does not engage in network management. For information about the network management practices of the third-party broadband providers whose services Spectrotel resells, please consult the disclosures available on those providers’ websites by using the links below. To the extent the network management practices disclosed on the third-party provider’s website differ from those applicable to the service resold by Spectrotel, Spectrotel will disclose any such differences at the point of sale.

Network Performance

Spectrotel resells broadband Internet access services from third-party providers that employ a variety of technology platforms, including but not limited to T1 (DS1), fiber, cable, DSL, Ethernet over copper, mobile wireless, and fixed wireless technologies. For any mass-market broadband Internet access service resold by Spectrotel, the performance characteristics of that service—such as the service’s expected and actual speed, latency, and packet loss during average use and peak times, as well as the suitability of the service for real-time applications—will depend on the performance of the underlying third-party provider’s network in the relevant geographic area. To the extent the performance characteristics disclosed on the third-party provider’s website differ from those applicable to the service resold by Spectrotel, Spectrotel will disclose any such differences at the point of sale.

Commercial Terms

The terms of service for the mass-market broadband Internet access offerings available through Spectrotel are set forth in the materials specific to each offering and are provided to customers when they sign up for service. The information below highlights three specific issues that the FCC has directed broadband Internet access service providers to address.

1. Pricing

Because Spectrotel operates as a reseller of third-party broadband Internet access services, there is no uniform monthly pricing that applies to all of Spectrotel’s broadband offerings. Rather, Spectrotel’s pricing for a particular retail customer depends on the wholesale rates currently offered by the third-party providers serving that customer’s geographic area, the type of Internet access desired by the customer (fiber, cable, DSL, wireless, etc.), and the service attributes sought by the customer (speed, data allowances, etc.), among other factors. When a potential customer requests service, Spectrotel evaluates the available third-party options in the relevant geographic area and provides a quote to the potential customer detailing the applicable pricing and other commercial terms, including the monthly service charge, any promotional rates, and any other fees to be paid in connection with the service. When a customer signs up for service through Spectrotel, that pricing is memorialized in the customer’s service agreement with Spectrotel. Spectrotel provides customers 30 days advance notice of price increases.
